A Joyful Journey of Learning Civil and Commercial Law
After the exciting foundational lectures on civil and commercial law in the first half of the semester, the second half of the Beyond course was filled with numerous activities centered around antitrust law and international commercial arbitration. Students first had the opportunity to learn about the differences between arbitration and litigation from a judge of the Shanghai High People's Court, gaining a concrete understanding of concepts such as confidentiality, finality of arbitration, and enforcement of judgments. They also gained some understanding of legal concepts such as abuse of a dominant market position and horizontal/vertical monopolies through vivid case studies.
After some theoretical lectures, the coach and key members of the East China University of Political Science and Law's distinguished moot court team visited SHSID, presenting complex cases involving telecommunications fraud and international commercial contract disputes to high school students through real cases from the internationally renowned Vis Moot competition. After diligent reading of the cases and serious preparation for guiding questions, the students efficiently and accurately posed various questions to the guest mentors, sorting out complex facts and intricate legal provisions. In the final class, four representative students performed a contentious arbitration simulation representing both sides. The guest mentor, acting as the arbitrator, gave very high praise regarding the students' English expression, application of legal provisions, and on-the-spot reactions, inspiring students to reach higher in college and beyond.
The Beyond course over the whole semester offered SHSID high school students opportunities to listen to the insights and perspectives of various legal experts and scholars. They not only gained more knowledge but also ignited interests in legal study and application.
